James Kennedy is an experienced trial lawyer who has litigated a broad spectrum of complex business and intellectual property disputes before many state and federal courts and arbitration panels, for clients ranging from entrepreneurs to Fortune 50 companies. Before he founded Kennedy Johnson LLC, in May 2004, he was a partner for 12 years in the New York litigation department at Paul, Hastings, Janofsky & Walker LLP.

Mr. Kennedy’s vast commercial litigation experience encompasses commercial contract disputes involving partnership agreements, commercial real estate leases; real property purchase and sale agreements, distribution agreements, supply agreements, franchise agreements, limited liability company operating agreements, intellectual property licensing agreements, technology development contracts, computer software agreements, restrictive covenants and non-competition agreements; commercial real estate disputes; shareholder disputes involving alleged breaches of fiduciary duties and intellectual property disputes pertaining to trade secrets, trademarks and patents; bankruptcy matters and securities law disputes.

Mr. Kennedy has successfully tried or arbitrated significant cases involving the application of a dilution provision in a stockholders agreement, claims of misappropriation of trade secrets in the fields of optics and cable modem technology, breach of various commercial lease provisions, false television advertising involving consumer goods, claims of patent infringement involving semiconductors and flexible head toothbrushes; and breach of a franchisee’s valuable contractual right of territorial exclusivity to a high-fashion designer franchise.

Mr. Kennedy was graduated cum laude from St. John’s University School of Law in 1984. He is the former Law Secretary to the Honorable Bernard S. Meyer of the Court of Appeals of the State of New York. He was also employed for several years as an associate at Skadden, Arps, Slate, Meagher and Flom and for two years as a associate and partner at Milgrim, Thomjan & Lee, P.C.
